Letter of Testamentary

March 26, 2018 1:27 PM Tyler Edmondson

Letter of Testamentary

A letter of testamentary is essentially a document that is issued by the court or public official authorizing the executor of the Will to obtain control of the deceased’s estate. So what does this mean exactly? It means that it’s legal proof that the person who is going to be the executor to have control of the estate. The executor is responsible for a variety of things. For example, it’s the executor’s job to inventory the estate, pay off outstanding debts, and distribute the estate accordingly to the Will. When dealing with banks or other financial institutions, estranged family members, or anyone else he doesn’t know, this letter is the proof that you will need to get business done accordingly. By having a letter of testamentary, the whole process of dealing with an estate after a loved one has died can be much simpler.

Have the Letter Drawn Up Before It’s Too Late

The letter of testamentary is just as important as the Will itself. The problem, however, is that many people procrastinate on getting these documents drawn up. This, of course, is very problematic as before you know it, it’s too late. If your loved one never gets the Will or letter of testamentary drawn up and then passes, you being the executor are going to have a much tougher time trying to handle the affairs of the estate. It is for this reason that you need to have all estate planning documents completed as soon as possible. This includes the Will, the letter of testamentary, the muniment of title, or anything else. It’s something that you don’t want to think about because all of this means the inevitable passing of your loved one. But you’ll want to do yourself a favor and go and get these documents drawn up before it’s too late.

What Is a Probate of the Estate?

March 19, 2018 12:29 PM Tyler Edmondson

What Is a Probate of the Estate?

Essentially a probate estate is all of the assets that a person owns at the time of his or her death that is subject to probate administration. Probate administration is essentially the process of proving to the court that a final Will and Testament is actually legitimate or genuine. And as such, several types of assets comprise a probate estate. A few examples are all assets held in the descendant’s name. All assets the descendent owned as a tenant in common with other persons, all assets payable to the estate because the estate is the designated beneficiary or the asset has no designated beneficiary. Also, amounts owed to the descendent before the death but was paid in full after death and household items such as jewelry or other precious items.

Complicated Process

All of this may seem very complicated. The reality is that it can be complicated and long. If you have been chosen to be the executor of an estate then you have to go through the legal process of making sure that the estate is handled in the manner that the descendent wanted. So by having probate of the estate you are proving that the person’s final wishes are truly their final wishes. Then you can go about dissolving the estate accordingly. This is definitely a task that is complicated and perhaps not best tackle in the loan. This is especially true if you have no legal background. In order to make this as painless as possible, you should really seek legal assistance. By having a competent team of lawyers help you with the probate process, you will have a much easier time probating the estate.

You’ve seen this hobby language over the years, and you want to do everything in your ability to help re-energize the hobby in your area. Skirting Responsibility

Skirting Responsibility

Were you in a relationship and then after a period of time and you had become pregnant? Now that you are pregnant, the father is trying to skirt his responsibility by denying that he is the legitimate father of your child. You should not feel ashamed, situations like this occur all too often. You know that he is the father and that he is only trying to get out of taking financial responsibility for his actions. This is grossly unfair to you, and you cannot let him get by with this. If he’s the father, then he needs to be there for the child, preferably both by being there and taking on his responsibility for finances. But first, you must prove that he is indeed the father to the court.

This is where the task might seem daunting. The court system can be very intimidating. In order to have the father take on his part of the financial responsibility, you must prove to the court that he is indeed the father. By simply going in on your own, you are greatly diminishing your chances of success. In the court, it a matter of your word against his and less efficient evidence with the sound the legal argument can be presented. You do not have the training necessary to navigate this legal system efficiently. It’s for this reason that you need an excellent law team on your side to help you fight for the future of you and your child. With a law team on your side, you will be able to present to the court the man in question is indeed the father and should be held financially responsible for the child that he has fathered.
