Skirting Responsibility

Skirting Responsibility

Were you in a relationship and then after a period of time and you had become pregnant? Now that you are pregnant, the father is trying to skirt his responsibility by denying that he is the legitimate father of your child. You should not feel ashamed, situations like this occur all too often. You know that he is the father and that he is only trying to get out of taking financial responsibility for his actions. This is grossly unfair to you, and you cannot let him get by with this. If he’s the father, then he needs to be there for the child, preferably both by being there and taking on his responsibility for finances. But first, you must prove that he is indeed the father to the court.

This is where the task might seem daunting. The court system can be very intimidating. In order to have the father take on his part of the financial responsibility, you must prove to the court that he is indeed the father. By simply going in on your own, you are greatly diminishing your chances of success. In the court, it a matter of your word against his and less efficient evidence with the sound the legal argument can be presented. You do not have the training necessary to navigate this legal system efficiently. It’s for this reason that you need an excellent law team on your side to help you fight for the future of you and your child. With a law team on your side, you will be able to present to the court the man in question is indeed the father and should be held financially responsible for the child that he has fathered.

The Struggles of an Aging Parent

February 26, 2018 3:22 PM Tyler Edmondson

The Struggles of an Aging Parent

Getting old is just a fact of life. It’s something that cannot be avoided. Many of us will age, and our parents will age ahead of us. Your parents took care of you as a young child. They were there for you through all the heartache and injuries and support that you needed. Now in their golden years, they need you to be that support for them. As they age, their health is going to deteriorate, and they’re going to need assistance. There will be several types of aid that they are going to need. There is, of course, financial assistance. They also may need physical help like help bathing, getting dressed and they’re going to need help preparing their food. That’s the cruel trick of nature as you age you lose your independence.

Power Of Attorney

Part of supporting your parents at this age is to take responsibility for their finances and their health. The elderly can get confused easily and make them easy targets for scammers. Or in regards to medical issues, not make the best decision for their health. These are common problems that anyone who has dealt with an aging parent has experienced. It is for this reason that it is advised that you assume power of attorney over your parent’s finances and healthcare. If your parents are no longer able to make decisions on their own, it is for their benefit that you do so. If you do not assume power of attorney then legally your parents will still be left to make their own decisions, and as you’ve seen, that is not the best option. It will be hard, and it is possible you may receive resistance on this, but you need to practice some self-reflection and decide if it is the decision that is right for you and your family.

Family Law Attorneys

If you have reached a decision and need help assuming power of attorney over your parent’s, then you must make sure to pick the right firm. You need to make sure to pick a law firm that has experience in family law. Edmondson Law, PLLC is a firm that does indeed specialize in family law and will help you all along the way during this difficult process. So if you need to assume power of attorney over your parents then please don’t delay and give us a call.

Do Not Leave Your Family in a Bind

February 19, 2018 4:30 PM Tyler Edmondson

Do Not Leave Your Family in a Bind

No one wants to think about death. The harsh reality, however, is that death is an inevitability. Your passing will no doubt be very hard on the people who love you. The last thing you would want to do is to make things harder for them. Sadly, many people do not have enough foresight to realize the pain they will cause after they leave and do not have their affairs in order. This causes a wide variety of troubles within the family such as infighting petty disputes and heartbreak. Most of this fighting is directly related to the fact that family members simply do not know what the departed truly wanted. Families can be torn apart because of such issues. This, of course, is truly a tragedy.

The Value of Planning Ahead

We understand you do not want this to happen to your family. This is why it is important that you think ahead and make sure to have a final Will and Testament in place. With a final Will and Testament in place, your loved ones will know exactly what your desires were and what you wanted. This will ensure that no one will fight or argue or get upset about how your estate will be handled after you pass. This way everyone can concentrate on getting through your loss instead of worrying about what other members of the family are trying to pull over on them. You, of course, may think that your family is above this. We all like to think the best of our loved ones. The reality, however, is far different. It is simply human nature that cannot be avoided. That is why steps must be taken now to ensure there is no trouble later.

Estate Planning and Probate Attorney

If you don’t want to leave your family in a bind when you pass and want to create a final Will and Testament so that your wishes will be known with no dispute, then you need a skilled law team to oversee this. Edmondson Law is comprised of a team of skilled lawyers that know and understand the legal system. Our law team will help you through this process to ensure that a proper legal document is drafted and the right measures are taken to ensure a smooth transition of your estate after you have passed. Protect your Assets

February 12, 2018 1:15 PM Tyler Edmondson

Protect your Assets

So, you have found the love of your life, and the two of you have decided to tie the knot. We could not be happier for you and will be the first to congratulate you on this lifelong commitment. Before you tie the knot, we would suggest, however, to take a step back and think about things. What is your current net worth? What investments do you have? What property or business do you own? All of these things have nothing to do with your significant other. You are the one that has made these investments or have built these companies. If you two were to get a divorce a few years down the road, it is possible your husband or wife will be entitled to part of your investments or capital that you had built before the marriage.

Pre-Marital Action

You have to ask yourself if it is really worth the risk to lose all of the work you have poured into something because of a nasty divorce. The answer is, more than likely not. The best way to protect your pre-marital assets is to form a pre-marital agreement. In a pre-marital agreement, you will line out what is off the table in the event of a divorce. Your fiancé would surely understand that they did not help to build these investments and should understand your concerns and willingness to prepare for the worse. With a pre-marital agreement in place, there can be no debate as to what is on the table for the split up. That way you will not have to worry about losing everything you built before the marriage.

Edmondson Family Law Attorney

You can not make a pre-marital agreement a mutual understanding. The agreement must be drafted as a legal document in order for the courts to recognize it. Like all legal documents, the best way to make sure that your interests are protected is to have an expert law team to draw up the paperwork. Edmondson Law, PLLC is a law firm in the Sachse, Murphey, Wylie area that specializes in family law and will be able to help you draft up the necessary paperwork to ensure that your assets are secured before you take that next step. Call today and set up an appointment at 972-442-8326 or www.wylietxlaw.com.

The Joys of Non-Profit Organizations

February 5, 2018 1:01 PM Tyler Edmondson

The Joys of Non-Profit Organizations

Non-profit organizations are a great thing for society. Most worthy endeavors are to try to better society, and the goal is not to make profits but rather to do good deeds. The goal of a non-profit is not to gain profits at the expense of others, but typically to enrich the lives others. There are a variety of non-profits groups that have many focuses. Some may be to feed the hungry, while others may simply focus on spreading information. No matter the focus, people who take part in non-profit organizations find them very enriching.

Complications of the Non-Profit

As great as non-profits are, they are not simple to create. The non-profit organization is a corporate entity, and as such it must comply with business law. This is indeed a very intimidating endeavor to someone who does not really understand the ins and outs of business law. The reason why corporate law applies to non-profit organizations is that of the tax codes that are in place. The IRS must make sure that the non-profit is truly non-profit and as such can maintain its tax status. If this were not in place, then many cooperation would claim to be non-profit organizations. This is not fair to those that do truly wish to perform good works. So, if you truly have the calling to perform good deeds then do not let the daunting task of forming one stand in your way.

Wylie Business Law Attorney

I know what you are thinking, “how can I navigate these legal waters to realize my goal?” The answer is simple. Hire a well-versed law team to help you on your way. The right law team will be able to help you navigate the tricky waters to create your non- profit organization. If you want to form a non-profit organization in the Wylie, Sachse or Murphy area, then please do not delay and contact Edmondson Law PLLC. Stop by or check out our site at www.wylietxlaw.com for more information on our services.

Driver License Issues

January 29, 2018 4:38 PM Tyler Edmondson

Driver License Issues

We all get tickets. It does not make you a wrong person. You may have been speeding just slightly over the speed limit. Maybe you got nabbed in a speed trap. There are a variety of other traffic violations that the local municipality may give you. When you get a ticket, it is such a hassle. You have to take the time to go down to the courthouse. This in itself is a mess since the courthouse is located in the downtown area. Once there you have to wait in a long line to get designated to a courtroom. After that, you move into the courtroom where you have to wait your turn to see the judge and be thrown at the mercy of the municipal justice system.

Inside the Courtroom

Once you have made your way into the courtroom and you are now in the presence of the district attorney and the judge you may be at a disadvantage. When you get into those wheels of justice, you may feel intimidated. The authorities know this and can use it to their advantage. As such they will manipulate you into going along with possibly unfair punishments and not let you know all of the options that are available to you. This is not fair to you. As a citizen, you have the right to know what options are available to you. You do not deserve to be taken advantage of. But how can this be helped? You can not help how you feel when faced with this situation. It is not like you can merely steel your nerves in an instant when you are out of your element, but placed in the court’s element.

Wylie Traffic Attorney

What you need is someone who will not be intimidated inside that courtroom. Someone that has chosen as their profession a career that places them in that very system as a defender of the people who is intimidated by that system. By having a competent traffic attorney go to bat for you, you will come out knowing what your options are, and have the best guidance on which option you should peruse in order save your driving record and your pocketbook. If you have been given a traffic violation, then do not delay, and give our offices a call.

They are Your Kids Too

January 26, 2018 5:13 PM Tyler Edmondson

They are Your Kids Too

Divorce is a tough time. And for any parent who has been served with divorce papers, now faces the uncertainty of the role they will play in the life of their children. Some may say that Texas is a mommy state, meaning that women are more likely to gain custody than men. This is for a variety of reasons. Some might believe that being the male makes you the breadwinner and does not leave father time to take or pick the kids up from school. As such, the female may seem like the better candidate. This is not fair to the father as he loves his children and deserves to play a role in their lives. Dads have come a long way. Lately, it seems like there is not an automatic decision that the mom will get primary custody. Although when younger children are involved, the mother’s may tend to grant the mother custody. It’s may not be likely when older children are involved; dads have a real shot at 50-50 custody.

Protect Yourself and the Well Being of Your Children

The D-Word

January 8, 2018 12:42 PM Tyler Edmondson

The D-Word

Whenever people get married, the last thing they think is that this happy union will end in divorce. The reality is that no one can truly foresee the future. The sad reality is that people change over time. So while you may have been perfect for each other in the beginning, as both of you have aged and matured you have changed and come to the realization that maybe you are not compatible together anymore. You decide that staying in this relationship is unhealthy to both of you, and the best course of action is for you two to call it quits and move on with your lives. This, of course, is easier said than done, and there are issues at hand that may cause the split to be not so painless.

Complications of Divorce

Getting a divorce is not as easy as just breaking up with a boyfriend or a girlfriend. You have built a life together. So there are several reasons why divorce may be a complicated issue. The first and foremost is children. Children complicate the divorce as both parents truly love their children, and want to have their children with them. The issue custody and kids are often what makes a divorce such a messy ordeal. Many say that it is for this reason that they do not divorce. They “stay together for the children.” One has to ask themselves though, is it really in the best interest for the kids to live in a household where the marriage is not working out? The answer is no. So while a custody battle maybe heartbreaking ordeal just bear in mind that in the long run, it is truly better for everyone involved.

Edmondson Law Attorney

If you are faced with divorce, and there is a custody battle looming you do need to make sure that your interest is diligently represented. This means that you need a competent team of lawyers on your side and fighting for you to have a maximum role in your children’s life. The Struggle of a Suspended License

January 5, 2018 4:42 PM Tyler Edmondson

The Struggle of a Suspended License

We live in a day and age that one must have a car and be able to drive. The reason for this is because everything is so spread out and not typically within walking distance. No one works or goes to school within walking distance. They have to drive. This, of course, is the side effect of urban sprawl that occurred in the 1950s and 1960s with the rise of the suburbs. People moved away from the inner-city and into the suburbs. With the roads that were put in place, this was really no big deal as it was not a chore to simply drive to work. It is easy to see, however, that if someone does not have a driver’s license or a car they are put at an extreme disadvantage in regards to upward mobility in society.

The Unfair Disadvantage

This is what makes having a suspended driver’s license so arbitrary. Yes, if you broke the law then you deserve to be punished within reason. But if you have your driver’s licenses suspended then you may have to quit your job, quit school, or other life-altering situations that you may never recover from. If the idea of the punishment is to rehabilitate, then this is the furthest from the proper punishment. As a person that no longer has a driver’s license can no longer be a productive, law-abiding, member of society. This is surely not what the judge had intended when judgment was passed. In order to keep your life on track and to learn from your mistakes, you must be able to work still and progress in life. If your license is suspended, then this is impossible.

Edmondson Law Criminal Law Attorney

If you have had your driver’s license suspended for any reason, you know the dire situation you are facing. There, surely was another suitable punishment for you that would not ruin your life. This is clearly a grey area in our legal system that causes more social distress then good. If you have found yourself with no way to travel to work or school because of a suspended drivers license, then please do not delay and give our offices a call. We at Edmondson Law will do what we can to try to get your life back on track and get your driver’s licenses reinstated. Look us up online at www.wylietxlaw.com for more information.

Do You Have a Will?

January 2, 2018 3:33 PM Tyler Edmondson

Do You Have a Will?

A final Will and Testament is not something that people like to think about. The thought of going to the other side is terrifying to most. The sad reality, however, is that this causes people not to prepare for the inevitable. When a person does not have their final wishes documented, it becomes an enormous burden for the family, and worse, it can cause a real rift in a family as people begin to fight over what they thought the deceased wishes were. Is this really what you want your family to go through? More than likely not. Now I know what you are thinking. I am young all considered, do I really need a Will? The answer is still a resounding yes. You have no idea when you may die; it could be tomorrow in an accident.

Are You Sure Your Family Knows?

You may still be apprehensive. You may make the argument that your family knows what you want after you pass. But do they? WE have seen case after case of families torn apart because each member has a differing interpretation as to what you wanted after you have passed. This can have irreconcilable consequences and split the family apart forever. Is that what you want as your legacy? Surely not. So the best way to combat this is to have a final will and testament in writing so that there can be no disputing or fighting after you have passed. It is indeed never too early to do this. As tomorrow could be your final day. The reality is that your family will be going through so much that it is not fair to them to put them through the conflict that will arise.

Wylie Family Law Attorney

Where can you go to get a final Will and Testament drafted? You do not want to try to do something like this online or by yourself. The legitimacy of the document may be brought into question. The best answer is to count on a component law team to draft the document to make sure that everything is done correctly. If you want to prepare a final Will and Testament, then do not delay and give our office a call. You can also look us up online at www.wylietxlaw.com for more information.
