They are Your Kids Too

They are Your Kids Too

Divorce is a tough time. And for any parent who has been served with divorce papers, now faces the uncertainty of the role they will play in the life of their children. Some may say that Texas is a mommy state, meaning that women are more likely to gain custody than men. This is for a variety of reasons. Some might believe that being the male makes you the breadwinner and does not leave father time to take or pick the kids up from school. As such, the female may seem like the better candidate. This is not fair to the father as he loves his children and deserves to play a role in their lives. Dads have come a long way. Lately, it seems like there is not an automatic decision that the mom will get primary custody. Although when younger children are involved, the mother’s may tend to grant the mother custody. It’s may not be likely when older children are involved; dads have a real shot at 50-50 custody.

Protect Yourself and the Well Being of Your Children

You do deserve to play a role in your children’s lives. At the same time, you also realize that you must protect your financial means to do so. The D-Word

The D-Word

Whenever people get married, the last thing they think is that this happy union will end in divorce. The reality is that no one can truly foresee the future. The sad reality is that people change over time. So while you may have been perfect for each other in the beginning, as both of you have aged and matured you have changed and come to the realization that maybe you are not compatible together anymore. You decide that staying in this relationship is unhealthy to both of you, and the best course of action is for you two to call it quits and move on with your lives. This, of course, is easier said than done, and there are issues at hand that may cause the split to be not so painless.

Complications of Divorce

Getting a divorce is not as easy as just breaking up with a boyfriend or a girlfriend. You have built a life together. So there are several reasons why divorce may be a complicated issue. The first and foremost is children. Children complicate the divorce as both parents truly love their children, and want to have their children with them. The issue custody and kids are often what makes a divorce such a messy ordeal. Many say that it is for this reason that they do not divorce. They “stay together for the children.” One has to ask themselves though, is it really in the best interest for the kids to live in a household where the marriage is not working out? The answer is no. So while a custody battle maybe heartbreaking ordeal just bear in mind that in the long run, it is truly better for everyone involved.

The Struggle of a Suspended License

January 5, 2018 4:42 PM Tyler Edmondson

The Struggle of a Suspended License

We live in a day and age that one must have a car and be able to drive. The reason for this is because everything is so spread out and not typically within walking distance. No one works or goes to school within walking distance. They have to drive. This, of course, is the side effect of urban sprawl that occurred in the 1950s and 1960s with the rise of the suburbs. People moved away from the inner-city and into the suburbs. With the roads that were put in place, this was really no big deal as it was not a chore to simply drive to work. It is easy to see, however, that if someone does not have a driver’s license or a car they are put at an extreme disadvantage in regards to upward mobility in society.

The Unfair Disadvantage

This is what makes having a suspended driver’s license so arbitrary. Yes, if you broke the law then you deserve to be punished within reason. But if you have your driver’s licenses suspended then you may have to quit your job, quit school, or other life-altering situations that you may never recover from. If the idea of the punishment is to rehabilitate, then this is the furthest from the proper punishment. As a person that no longer has a driver’s license can no longer be a productive, law-abiding, member of society. This is surely not what the judge had intended when judgment was passed. In order to keep your life on track and to learn from your mistakes, you must be able to work still and progress in life. If your license is suspended, then this is impossible.

Edmondson Law Criminal Law Attorney

If you have had your driver’s license suspended for any reason, you know the dire situation you are facing. There, surely was another suitable punishment for you that would not ruin your life. This is clearly a grey area in our legal system that causes more social distress then good. If you have found yourself with no way to travel to work or school because of a suspended drivers license, then please do not delay and give our offices a call. We at Edmondson Law will do what we can to try to get your life back on track and get your driver’s licenses reinstated. Look us up online at www.wylietxlaw.com for more information.

Do You Have a Will?

January 2, 2018 3:33 PM Tyler Edmondson

Do You Have a Will?

A final Will and Testament is not something that people like to think about. The thought of going to the other side is terrifying to most. The sad reality, however, is that this causes people not to prepare for the inevitable. When a person does not have their final wishes documented, it becomes an enormous burden for the family, and worse, it can cause a real rift in a family as people begin to fight over what they thought the deceased wishes were. Is this really what you want your family to go through? More than likely not. Now I know what you are thinking. I am young all considered, do I really need a Will? The answer is still a resounding yes. You have no idea when you may die; it could be tomorrow in an accident.

Are You Sure Your Family Knows?

You may still be apprehensive. You may make the argument that your family knows what you want after you pass. But do they? WE have seen case after case of families torn apart because each member has a differing interpretation as to what you wanted after you have passed. This can have irreconcilable consequences and split the family apart forever. Is that what you want as your legacy? Surely not. So the best way to combat this is to have a final will and testament in writing so that there can be no disputing or fighting after you have passed. It is indeed never too early to do this. As tomorrow could be your final day. The reality is that your family will be going through so much that it is not fair to them to put them through the conflict that will arise.

Wylie Family Law Attorney

Where can you go to get a final Will and Testament drafted? You do not want to try to do something like this online or by yourself. The legitimacy of the document may be brought into question. The best answer is to count on a component law team to draft the document to make sure that everything is done correctly. If you want to prepare a final Will and Testament, then do not delay and give our office a call. You can also look us up online at www.wylietxlaw.com for more information.

Age In Texas Child Can Choose Parent

February 14, 2014 12:18 AM W. Tyler Edmondson

The most common question I get asked in my practice is what age a child must be in order to choose the parent that child gets to live with primarily. The fact is that a child in Texas does not have the absolute right to “choose” the parent they will live with primarily. The law in this area has changed recently to correct some of the unforseen problems that resulted from prior statutes dealing with this issue.

Under the old law, attorneys would get an affidavit from a child 12 years or older that stated which parent the child “chose” to live with primiarily.  The Judge would consider the affidavit in determining what was in the best interest of the child, but was not required to follow the child’s wishes.  The unforseen result of this statute is that it brought the child right in the middle of the couple’s dispute.

The new law, outlined in Texas Family Code Section 153.009, does away with the prior law’s affidavit requirement and allows a child 12 years or older to be interviewed in the Judge’s chambers to determine the child’s wishes as to conservatorship or as to the person who shall have the exclusive right to determine the child’s primary residence.  The Judge will consider the child’s wishes in determining what is in the child’s best interest but is not required to follow the child’s wishes.

Although the law has changed recently, the answer to the question remains the same in that a child in Texas does not have the right to choose which parent the child will live with primarily.  At age 12, the child may be interviewed by the Judge to suggest which parent the child would “choose” and the Judge will consider this in determining what is in the child’s best interest.

DWI For Prescription Drugs In Texas

August 16, 2013 8:41 PM W. Tyler Edmondson

All of us are aware that driving with a blood alcohol content of .08 or higher is considered driving while intoxicated (DWI) in Texas. A much more controversial issue is whether a person can be charged with a DUI or DWI for being under the influence of a prescription drug. The fact is that even if you are prescribed to certain medications, you may still be cited for a DUI or DWI for being under the influence of a prescription drug.

In Texas, Driving While Intoxicated is determined in one of three ways: (1) having a blood alcohol content (BAC) of .08 or higher, (2) not having your normal mental faculties, or (3) not having your normal physical faculties due to alcohol or drugs in your system. There is not a .08 standard for prescription drugs, which means that the police officer’s perception of your behavior is largely what a judge or jury will use to decide your case. This is precisely why it is so important to discuss these issues with a licensed attorney.

If you need representation for a DWI or DUI in Collin County, it’s time to call Edmondson Law. W. Tyler Edmondson knows the system and the people who run it. He can bail you out of jail cheaper and faster than a bail bondsman and can represent you in your criminal case. If you want an excellent trial attorney who focuses on being affordable, W. Guardianship For Minor Children

July 26, 2013 9:10 AM W. Tyler Edmondson

If you are the parent of a minor child you should seriously think about who will be the guardian of your child if something was to happen to you. Most married couples have already discussed this issue and have the candidate in mind but they fail to take the next and most vital step. If the couple fails to provide for guardianship, generally in their wills, the court would be left to pick a guardian based on what the judge feels is in the child’s best interest. Statutory guidelines are used by the judge but the reality is that if not provided for by the parents, a person who doesn’t know you or your child would be deciding on who would take care of them once you are gone.

If you would like to ensure that your child is provided for if something happens to you, Edmondson Law can help by drafting you a will with guardianship provisions. Right now we have a summer will special, which means that you won’t find a more affordable deal anywhere. Take that next step today by calling estate attorney W. Tyler Edmondson at (972) 442-8326 or email at tyler@wylietxlaw.com

Options When Facing A Drivers License Suspension In Texas

July 24, 2013 12:36 PM W. Tyler Edmondson

If you are facing a suspension of your Texas Drivers License and need to drive for work, school or other important activities, you may be eligible to drive during the suspension period if you receive an Occupational Drivers License. An Occupational Drivers License is a restricted form of drivers license that generally allows the individual to drive for work, school or household duties. A request to a county or district court must be made and a hearing will be held to determine if the individual is eligible to receive an Occupational Drivers License. The court will then issue an order that authorizes the Texas Department of Public Safety to issue the license. The DPS has additional requirements that must be met to ensure that the license is issued.

At Edmondson Law we understand these requirements and offer affordable pricing to help people receive an Occupational Drivers License. Certain eligibility restrictions through the DPS do apply so it is always best to discuss these issues with a licensed criminal attorney. If you are looking for an suspended license lawyer in Collin County, W. Tyler Edmondson is the attorney for you. Call him today at (972) 442-8326.
