Speeding In A Construction Zone With Workers Present

This leaves the offender with the option of pleading guilty or having a trial in these types of courts. Driving Safety Course Eligibility

Many Wylie, Sachse and Murphy motorists who receive traffic citations opt for the driving safety course to keep the ticket off of their record. Guilty or No Contest Pleas in Wylie, Sachse and Murphy

Many courts in Collin County only allow a criminal defendant the option of pleading guilty if deferred disposition is offered. Wylie Municipal Court does allow the defendant to choose whether to plead guilty or no contest when deferred disposition is available. So what’s the main difference between the two?

A no contest plea is a criminal defendant’s pleading that does not admit guilt but subjects him or her to punishment as though a guilty plea had been entered, the determination of guilt remaining open in other proceedings. If a civil lawsuit is brought against the defendant where the criminal case is of significance, the no contest plea might not be admissible in the civil proceeding. A guilty plea, on the other hand, might be admissible in a civil proceeding where the criminal case is of significance.

Presumption of Paternity In Texas

Many people don’t realize that a man in Texas can be considered under the law as the presumed father of a child that is not his biological child. Texas Family Code Section 160.204 outlines the different requirements for a man to be considered the presumed father of a child.

Some common scenarios of where a man would be presumed to be the father of a child include:
1) He is married to the mother of the child and the child is born during the marriage.
2) He is married to the mother and the child is born within 300 days of the marriage being terminated.
3) He marries the mother after the child is born, voluntarily asserts he is the father and the assertion is in a record filed with the bureau of vital statistics, he is named as the father on the birth certificate or has promised in a record to support the child.
4) He lives in the same house as the child for the first two years of the child’s life and represents to others that the child is his.

Informal (Common Law) Marriage In Texas

The State of Texas does not require a formal marriage ceremony for a man and a woman to be considered married. In some circumstances the behavior of a man and a woman living together can be enough to establish an informal (or common law) marriage. Texas Family Code Section 2.401 outlines how an informal marriage can be created by allowing two unmarried persons to either:

(1) Sign a Declaration of Marriage (Tex. Fam. Code 2.402)
-or-
(2) Satisfy a Three-Part Test
(a) An Agreement To Be Married
(b) Couple Resided In Texas As Husband And Wife
(c) Couple Represented To Others They Are Married

Below is a brief guide outlining a person’s rights and the arrest process that generally takes place in Collin County.

WHEN QUESTIONED BY THE POLICE:
(1) You Can Remain Silent
(2) You Can Answer Questions, But This Information May Be Used Against You
(3) You Can Stop Answering Questions When You Chose And The Law Requires The Police To Cease All Questioning
(4) You May Consult With An Attorney Before Questioning, Have An Attorney Present For Questioning or Have An Attorney Appointed For You

RIGHTS AFTER ARREST:
(1) Right To Know The Charge Against You
(2) Right To Communicate Over The Phone With An Attorney, Family Member or Bondsman Once The Police Have Finished The Booking Process

ARREST PROCEDURES GENERALLY FOLLOWED:
(1) You Will Be Taken To The Detention Facility
(2) Upon Arrival To The Jail Or Shortly After You Will Be Allowed To Contact A Criminal Attorney Or Family Member
(3) You Will Be Informed Of The Charges Against You
(4) You May Be Required To: Participate In A Lineup, Prepare A Handwriting Sample, Say Certain Phrases Associated With The Crime, Wear Certain Clothes Or Give A Hair And Blood Sample
(5) You May Be Fingerprinted And Photographed
(6) You Will Go Before A Magistrate
